    The continuity billing question

    Free-trial-to-continuity is the offer that built the nutra industry — and the offer that gets 90% of nutra merchants terminated. It's not the model itself acquirers refuse; it's non-compliant execution. Underwriting will place your continuity offer if it meets five conditions:

    1. Clear pre-checkout disclosure. The full subscription terms (billing frequency, amount, cancellation method) appear on the checkout page above the buy button — not buried in a footer or a modal.
    2. One-click cancellation. US FTC ROSCA rule and the 2024 Click-to-Cancel expansion require that cancellation be at least as easy as sign-up. No phone-only cancellation flows.
    3. Pre-billing notice. Email or SMS reminder 3–7 days before the trial converts to a paid rebill, with a one-click cancel link.
    4. TCPA-compliant marketing. Any SMS marketing needs express written consent. Any email needs CAN-SPAM compliance with an unsubscribe link.
    5. Refund policy on-page. Visa VIRP requires the refund policy to be visible pre-checkout. "All sales final" is not compatible with continuity offers.

    Underwriting reviews product labels, sales-page copy, and email sequences for disease claims. One disease claim in an email autoresponder can void the underwriting even if the product page is clean.
